1. Acceptance of Terms

By using SakaFundi ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Platform. We reserve the right to update these Terms at any time, and your continued use constitutes acceptance of the updated Terms.

2. Definitions

• "Platform" refers to SakaFundi, the online marketplace connecting customers and service providers.
• "User" refers to any individual or entity using the Platform.
• "Customer" refers to a User who purchases services through the Platform.
• "Provider" refers to a User who offers services through the Platform.
• "Project" refers to a service agreement between a Customer and a Provider.
• "Platform Fee" refers to the 10% fee charged on completed projects.

3. User Accounts

To use the Platform, you must create an account and provide accurate information. You are responsible for maintaining the security of your account and for all activities that occur under your account. You must be at least 18 years old to use the Platform.

4. Services and Projects

Providers list services on the Platform, and Customers can hire them for projects. The terms of each project, including price, timeline, and deliverables, are agreed upon between the Customer and Provider. The Platform facilitates the transaction but is not responsible for the quality or completion of services.

5. Payments and Fees

Deposit: A deposit of 10% of the agreed price is required to start a project.
Platform Fee: A 10% fee is charged on the total project price.
Payment Methods: We accept M-PESA, Airtel Money, and other payment methods.
Refunds: Refunds are processed in accordance with our dispute resolution policy.

6. User Conduct

Users agree to:

• Provide accurate and truthful information
• Not engage in fraudulent or deceptive activities
• Not harass, abuse, or harm other users
• Not upload malicious content or viruses
• Not violate any applicable laws or regulations
• Not use the Platform for illegal purposes

7. Disputes

In case of a dispute between a Customer and Provider, both parties are encouraged to resolve the issue amicably. If resolution is not possible, either party can escalate the dispute to the Platform for mediation. The Platform's decision is final and binding.

8. Termination

We reserve the right to suspend or terminate your account at any time for violation of these Terms or for any other reason. You may also terminate your account at any time by contacting us. Upon termination, any outstanding payments will be processed in accordance with our policies.

9. Intellectual Property

The Platform and its content, including logos, trademarks, and designs, are the property of SakaFundi. Users retain ownership of their content but grant SakaFundi a license to use it for platform operations.

10. Disclaimer of Warranties

The Platform is provided "as is" without warranties of any kind. We do not guarantee the accuracy, reliability, or completeness of any content or services provided through the Platform.

11. Limitation of Liability

To the maximum extent permitted by law, SakaFundi shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of the Platform. Our total liability shall not exceed the amount paid by you to us in the preceding 12 months.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes shall be resolved in the courts of Kenya.
